Pure Terms & Conditions

All artists, practitioners, partners, patrons and collectors must read and agree.

Payment for goods and services is taken as acceptance in full of these terms & conditions.

1.0 Clubhouse eligibility

Pure welcome applications from artists, well being practitioners, patrons and collectors aged 18 years or older at time of joining/application

1.01 Membership is invited from all those working in the fields of creativity and wellness

2.0 Artists

All expenses associated with participating in events or exhibiting artwork with Pure must be met by the participant including insurance.

2.01 Pure exhibits and sells fine art including: painting, sculpture, ceramic, original print, drawing, glass, fine art jewellery, photography, fIlm, digital, mixed media and textile based fine art. Painted work can be in a variety of media, including oil, tempera, acrylic, ink, vinyl, watercolour and other dry mediums and can be on any form of support (canvas, paper, wood, plastic etc). Images of installations and mixed media constructions can be submitted as part of the membership application process, to demonstrate style and quality across a body of work, but will only be accepted for event exhibition if they contain elements for sale and by prior agreement with Pure

* Please note: Pure exhibits and sells only original artwork. For the purposes of Pure, the definition of original print is as follows: 

Works generated by the artist as an original limited edition artist’s print. Reproduction giclee prints are not admissible, however, we do accept original digital artwork. 

3.0 Applications

The Pure team will review all applications submitted for any reason. Selection/acceptance is not guaranteed, however, Pure pledge to give feedback and guidance to all applicants wherever possible.

4.0 Artwork for Sale

Presentation of artwork for sale at any Pure art fair, event and/or exhibition must always be presented to us in a professional manner to gallery standard 

Where framed: 

○  No scratches, dents or chips in the frame 

○   Corners must be filled and touched up if necessary

○   Where under glass, glass must be clean and scratch free.

○   There must be no visible dirt, hair, smudges or debris underneath the glass

○   Absolutely no clip or pre-made Ikea type frames will be accepted

○   Wall mounted work must be D ring corded or equivalent and ready to hang.

To ensure safe storage, all framed works and unframed canvases must be delivered to Pure in stiffy bags or similar, clearly labelled with artists name, title of work and image of work. Stiffy bags can be ordered via www.stiffybag.com .

All unframed work and sculpture must be adequately wrapped with bubble wrap etc.
If work requires plinth mounting, we would kindly request artists supply these wherever possible. Similarly, we would appreciate jewellery cases to be supplied by any fine art jeweller, in coordination with Pure. 

4.01 Artwork presented for sale online

Artwork submitted for exhibition will be listed for sale by Pure on the ARTSY platform. Artwork will remain listed for sale post exhibition for at least 3 months to optimise sale potential. After 3 months artists can request the artwork be removed from sale. If no request is received, the artwork will remain consigned to Pure for sale via the ARTSY platform.

4.02

Artwork accepted and presented for sale as part of an exhibition or event is considered consigned to Pure for the duration of the exhibition/event from acceptance and for 3 month post exhibition/event. After 3 months artists can request the artwork be removed from sale. If no request is received, the artwork will remain consigned to Pure for sale.

Should the artwork be sold by any means or channel while consigned to Pure, including by the artist themselves, full sales commission will be payable to Pure.

Failure to pay this commission in full will be considered a breach of contract.

5.0 Artist sales/Commission

All work submitted to Pure for sale online and physical exhibition must be for sale unless otherwise specified and agreed in advance.
Sales commission rates apply as per terms of membership.

5.01 Artwork Shipping

Shipping for sales “off the wall” will be managed by Pure.

Shipping for online sales will be managed by ARTSY shipping.

Pure will liaise directly with artists in this regard as and when sales occur.

6.0 Consumer rights

In accordance with consumer law, Pure offer a 14 day full money back guarantee. Thereafter, a refund will only be issued if goods purchased are proven to be faulty or not fit for purpose.

6.01 Pure potential professional development workshops, courses & programmes

We offer a 14 day full money back guarantee on all our workshops, courses and programmes.

A full refund will be issued if:

You have requested it within the 14 day cooling off period and you have not completed (or attempted to complete) any of the workshop, course or programme elements or participated in any Pure learning community interactions, activities or 1-2-1 sessions.

The 14 day cooling off period begins from the day you settle your invoice.

Refunds will not be payable after a workshop, course or programme has been started.

7.0 Copyright 

Copyright in all work submitted to and exhibited by Pure will remain the property of the artist. It is, however, a condition of participation and membership that Pure reserve the right to use all submitted images and/or text in whole or in part, together with film and photographic images taken at our events, exhibitions and residencies, for promotional and publicity purposes. 

Pure shall also have the right of free reproduction of all submitted and exhibited works for all catalogues, posters, postcards, DVDs, exhibition website and other promotional and educational material. Any enquiries regarding copyright will be referred to the artist. 

8.0 Photographing your artwork. Pure recommends artists have their artwork professionally photographed wherever possible. 

9.0 Indemnity 

Pure participants, members, partners, patrons and collectors shall indemnify and keep Pure indemnified against all and any action, claims, proceedings, losses, liabilities, charges, costs and expenses Pure may incur whatsoever in connection with exhibiting, showcasing, promoting and selling artists artwork and delivering its clubhouse and salon programme. 

10.0 Data Protection & GDPR

Pure will hold personal data supplied to it securely, in accordance with the Data Protection Act, 1998 and subsequent amendments to this legislation 

In compliance with GDPR regulations: 

The PURE Company policy is to respect your personal information and your privacy. We will not share or sell the information we hold about you to any other 3rd party or organisation.

Payment of submission/membership, joining or course fees will be taken as your unreserved acceptance of the entire contents of this document and consent to our storing and utilising as detailed the information supplied to us..

11.0 Disability discrimination and equality

Pure recognises and abides by the Disability discrimination and the Equality Act 2010

The Pure Company has a policy of complete inclusivity for all and endeavours to ensure all its products, services and events are open and accessible to all. It will never discriminate against anyone on the basis of age, gender reassignment, sex (i.e. man or woman), race, religion or belief, pregnancy and maternity, marriage and civil partnership, sexual orientation and disability and furthermore, will always endeavour to make all reasonable adjustments required to working and delivery arrangements and/or premises, in order to ensure the disabled are not being disadvantaged in any way. 

12.0 Disqualification

Pure reserves the right to disqualify from participation or cancel the membership of any members, partners, patrons or collectors who fail to adhere to the rules, act in a way that does not adhere to the Pure ethos or behave in such a way that does not reflect Pure values and high moral and ethical standards.

12.01 Members shall act at all times with due regard to public morals, conventions and the Pure ethos. If a member shall have committed or does commit any act, or if a member shall have conducted or does conduct himself in a manner, which shall be an offence involving moral turpitude under English Law, or which might tend to bring the member to public disrepute, contempt, scandal or ridicule, or which may embarrass, offend, insult or denigrate individuals or groups, or that may shock, insult or offend the community, Pure or public morals or decency or prejudice Pure, or which results in or is likely to result in actual or threatened claims against Pure, or which otherwise may reflect unfavourably upon Pure, Pure shall have the right to terminate there agreement with the member at any time following the date on which the commission of such act, or such conduct, shall have become known to Pure.

13.0 Insurance liability

Pure take every care to ensure artwork placed in their care is handled and stored appropriately, however, Pure strongly advise artists to insure their own artworks.

Pure accepts no responsibility for any artwork lost, stolen or damaged while in their care.

Submission and or acceptance of membership and/or payment of a membership, workshop, course or programme fee is taken as unreserved acceptance of the entire contents of this document. 

Pure reserve the right to update their terms & conditions of business at anytime.
